Extended Permitted Development for Hot Food Takeaways

The latest Amendment Order introduces a new Use Class known as 'DA' in Part 4 of the Second Schedule of the GPDO 2015.

This amendment allows already established restaurants and cafes (use class A3) and drinking establishments, both with and without existing food provision (use class A4) to temporarily change their use class to allow for the provision of takeaway food given the current Coronovirus pandemic.
The amendment is valid for a fixed one year time period only, commencing at 10:00am 24th March 2020 until end of day 23rd March 2021.
Whilst the amendment allows for new PD rights for takeaway food over this fixed period, there are still specific conditions by which the developer/business owner must adhere to. This includes the requirement for the developer/business owner to notify the Local Planning Authority if they intend to take use of the new takeaway food provisions. Additionally, at the end of the fixed time period, the developer/business owner must revert back to the original use class as it was at the commencement of the change of use.
