The Orchard, Chafford Lane, Fordcombe, Kent

Lanpro successfully removed an agricultural tie condition which was part of the original planning permission for a house in Fordcombe, Kent. This has allowed the owner to have the option to sell the property to a wider market.

An agricultural tie was placed upon the house in Fordcombe, Kent, as a condition of planning permission when it was constructed by the owners in 1969. The agricultural tie meant that only workers recently or currently working in agriculture or forestry could live in the dwelling.

This condition remained in place, despite the fact that the demographics of the area had completely changed in the intervening years, and the property had been occupied by non-agricultural workers for several decades. The client therefore approached Lanpro and asked for help remove the agricultural tie.

Lanpro set about gathering evidence to test whether the agricultural tie was still needed. Our research conclusively demonstrated that the agricultural tie had outlived its purpose and therefore it needed to be removed. Sevenoaks accepted the application and this means that the client could, if required, sell the property to a wider range of people, rather than just those employed in agriculture, and thus increasing the value of the property.
